RE: Design Spill Determination
Dear Mr. Wyatt:
The U.S. Department of Transportation’s Pipeline and Hazardous Materials Safety
Administration (PHMSA) has recently determined that FERC applicants should seek
design spill review and verification from PHMSA for compliance with the siting
calculations required under Title 49, Code of Federal Regulations, Part 193. We cannot
proceed with the review of the project in the above-referenced docket until this issue is
resolved. Once PHMSA determines the appropriate design spills to be used, we will
establish a revised schedule for issuance of the Environmental Impact Statement.
In accordance with the 1985 Memorandum of Understanding and the 2004
Interagency Agreement, FERC staff has been in consultation with PHMSA on the
determination of design spill selections required for the Part 193 siting calculations. The
selection of design spills is dependent on many variables and PHMSA has indicated that
the threshold for a minimum single accidental leakage source requires a determination
from PHMSA using site- and project- specific information. Please contact Charles Helm
